14. Governing Law and Arbitration

Any party seeking temporary or preliminary injunctive relief may do so in any state or federal court in Tennessee having jurisdiction thereof. Except as set forth above, the state and federal courts of Tennessee shall be the exclusive forum and venue to resolve disputes arising out of or relating to these Terms and Conditions or any use of merchandise sold through our Sites. By using our Sites, and thereby agreeing to these Terms and Conditions, users consent to personal jurisdiction and venue in the state and federal courts in Tennessee with respect to all such disputes.
15. Miscellaneous

Neither the course of conduct between the parties nor trade practice shall act to modify any provision of these Terms and Conditions.
